Welcome to Custom Canvas. By accessing our website and placing an order, you agree to the following Terms of Service.
1. Custom Image Uploads
When you use our “Custom Upload” feature, you acknowledge and agree to the following:
- Copyright Ownership: You warrant that you own the copyright to the image you are uploading, or you have explicit written permission from the copyright holder to reproduce it. You agree to indemnify Custom Canvas against any legal action, damages, or costs arising from copyright infringement regarding your uploaded files.
- Content License: You grant Custom Canvas a limited, non-exclusive license to use, modify, and print your uploaded image solely for the purpose of fulfilling your order. We do not claim ownership of your content.
- Prohibited Content: We reserve the right to refuse to print any content that is illegal, defamatory, or violates Australian law.
- Right to Refuse: While we support creative freedom, Custom Canvas reserves the right to refuse any order at our sole discretion. We may decline an order for any reason. If we cancel your order under this clause, a full refund will be issued.
2. Image Quality & Colour Accuracy
- Automated Quality Gauge: Our website features an automated “Quality Gauge” (e.g., Poor, Good, Excellent) to help guide your size selection. Please note this is a reference tool only. It calculates quality based strictly on pixel dimensions, not visual clarity.
- Subjectivity: A rating of “Excellent” means the file is large enough to fill the canvas, but it does not account for focus, lighting, grain, or compression artefacts in the original photo.
- Manual Review: While our team performs a secondary manual check, we cannot be held responsible if an image rated as “Good” or “Excellent” by the automated tool prints with inherent flaws (such as motion blur or focus issues) present in the original file.
- Screen vs. Print: Please be aware that all screens (phones, monitors) are backlit and display colours in RGB, while physical prints are reflective and produced in CMYK. Slight colour variations between what you see on your screen and the final product are normal and to be expected. These variations are not considered a manufacturing fault.
- Resolution Warning: We provide quality checks, but we are not responsible for the end result if you provide a low-resolution or blurry image. If our team flags an image as low-quality and you choose to proceed anyway, the final print quality is your responsibility.
- Cropping & Wrapping: For Canvas prints, a portion of the image edges may be wrapped around the frame (gallery wrap). Please ensure important details (like faces or text) are kept away from the very edge of your image.
3. Order Cancellations
Because our products are made-to-order, we begin processing jobs immediately.
- Standard Orders: You may request a cancellation within 1 hour of placing your order.
- After 1 Hour: Once the printing process has commenced with our manufacturing partners, orders cannot be cancelled or refunded.
- Cancellation for Low Quality: If our manual quality check determines your image is not suitable for printing at the selected size, we will attempt to contact you to discuss options. If we cannot reach you or a solution cannot be found, we reserve the right to cancel the order and issue a full refund.
4. Shipping & Delivery
- Delivery Estimates: Delivery times provided are estimates only. While we work with trusted Australian couriers, Custom Canvas is not liable for delays caused by the courier network, extreme weather, or peak seasonal periods (e.g., Christmas).
- Authority to Leave: Unless you specify otherwise, our couriers may leave the parcel in a safe place if you are not home. We are not responsible for theft or damage after the parcel has been delivered.
5. Limitation of Liability
To the maximum extent permitted by law, Custom Canvas shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our products. Our liability is limited to the purchase price of the product.
6. Governing Law
These terms are governed by the laws of Victoria, Australia. Any disputes arising from these terms shall be subject to the jurisdiction of the courts of Victoria.
